Waiver of Liability

The undersigned “Participant” desires to participate in Elisabeth McGinn Art Workshops LLC. short term art workshop in Florence, Italy. The term “ workshop” includes all activities throughout the trip and is not limited to actual art instruction time. In consideration for being permitted to participate in this art workshop, Participant acknowledges and agrees to the following: 

Participant is participating in the workshop of his/her own free will.

Participant understands and agrees that international travel involves inherent risks, hazards and dangers, including without limitation foreign, political, social and economic conditions different from those in the United States (and which can change in an unpredictable manner), differing standards of design, safety and maintenance of buildings, public spaces and transportation, varying quality of available medical treatment and differing health, safety, legal, cultural and religious beliefs and conditions, poor and/or inadequate water and sanitation, hazards of traveling by air, train, bus, automobile or other conveyance, possibility of accident or illness in remote places, exposure to acts of terrorism and/or civil unrest, war or forces of nature.

Participant agrees to assume all risk for personal injury, loss of life to Participant or property loss or damage in relation to the workshop.

Participant understands that Elisabeth McGinn Art Workshops LLC is not responsible for any medical expenses anywhere in the foreign country being visited and is not responsible for any medical expenses the Participant may incur while participating in the art workshop. Participant understands that Elisabeth McGinn Art Workshops LLC does not provide Participant with any insurance, whether health, accident or otherwise, in connection with this activity, and Participant states that that Participant is covered by an accident and health insurance policy which would provide insurance coverage for medical treatment outside the USA and medical evacuation if necessary.

Participant understands and agrees that Elisabeth McGinn Art Workshops LLC does not represent or serve as agent for and cannot control the acts or omissions of transportation carriers, hotels, villas, and other suppliers of goods and/or services in connection with this workshop. Participant agrees that Elisabeth McGinn Art Workshops LLC is not responsible for any personal injury to or loss of life of Participant or loss or damage to participant’s property that may be caused or contributed to by the act or omission of any suppliers of goods and/or services in connection with the workshop.

Participant agrees that participant bears the sole responsibility for any and all travel expenses which he/she incurs in the event Elisabeth McGinn Art Workshops LLC finds it necessary to send Participant home prior to the scheduled departure date, whether for health or physical limitations or inappropriate or improper behavior, and whether required during Participant’s participation in the workshop or not.

Participant agrees that Elisabeth McGinn Art Workshops LLC is not responsible for any injury participant may suffer while traveling independently before or after the workshop or during free time.

For and in consideration of Elisabeth McGinn Art Workshops LLC assisting me in the workshop, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, participant for himself/herself and his/her personal representatives, assigns, heirs, distributees, guardians and next of kin (herein the “Releasors”) hereby releases and discharges Elisabeth McGinn Art Workshops LLC and its affiliates, associates, agents, employees and volunteers including, but not limited to The d’Art Center (herein the “releasees”) of and from all claims, demands, rights and/or causes of actions of whatever kind or nature now or hearafter existing whether known or unknown, including but not limited to all liability to the Releasors on account of foreseen and unforeseen bodily and personal injuries, damage to property, and the consequences thereof, including death, resulting from Participant’s participation in the workshop, or in any way connected with Releases to the maximum extent permitted by law.

Elisabeth McGinn Art Workshops, LLC shall not be liable to the Participant due to cancellation or rescheduling of any workshop due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders or any other force majeure event.

Participant acknowledges that he or she has read this document and has had the opportunity to ask questions concerning this document before agreeing to the contents, that no oral representations, statements or inducements apart from the foregoing written agreement have been made to Participant, and that he/she voluntarily agrees to the same, thereby agreeing to be bound by all the above.
